Think about this, might be against the law but when the alleged burglar/rapist/etc gets away he can do it again and maybe someone will get injured or killed so the criminal was not shot fleeing away. Seems that the laws protect the criminals more then it does the victims.

There are indeed certain instances where the BG (Bad Guy) can be shot 'in the back'. If he were to turn when you surprised him and stsrted shooting, then he would receive an entry would in the back. The Police (and some places a citizen as well) are a little less restrained. There is a phrase : 'about to commit, during the commision of, and having just committed' which would apply to a situation where the BG may have just killed or seriously injured someone, is fleeing, and still poses a canger to the public whilst fleeing. This would fall under your question, the BG would indeed get shot 'in the back' and it would be considered a 'good shoot'
Keep in mind, that this may not apply in all jurisdictions or areas.
