I live in New Hampshire and my friend lives in Massachusetts. My friend wants to purchase a pistol that I've owned for four years. What type of paperwork do I need to fill out in order to comply with federal and state law? Would it be the same if I purchased a handgun from him? What about a the private sale of a rifle? Is this the same as handgun sale? Am I correct in assuming that there is a minimum time period during which I should own a firearm before selling it? If so, what is it? Any information would be appreciated.

Private sale of a rifle, as far as I know, is legal from contiguous states, if the seller does not believe the recipient is an inelegible person such as a person previously convicted of a felony.

Any # information would be appreciated. # # Thanks, # # Greg # On the federal level, this is an interstate firearms transfer between private parties, it has to go through an FFL dealer, regardless of whether it's rifle, pistol or shotgun, to be legal. You'll have to comply with whatever state nonsense exists on the buyer's end, waiting periods, handgun buying licenses or whatever. BATF has a site with the current state laws, same as the book they ship out to the FFLs every year. YOU are responsible for compliance, don't take mine or anyone else's legal advice here as the last word.
There are no 'time periods' needed to own a gun before disposal, things aren't quite that bad yet, though if you buy a number and sell them in a short period of time, you may get the interest of the BATF for dealing without a license. AFAIK, it's legal for you to buy a gun, like at a gun show, for somebody out of state as long as it goes through a dealer for the interstate transfer and both parties aren't prohibited from owning or buying a gun and state laws are complied with on both ends. If you do this a number of times(number not defined by BATF), and can be shown as profiting by it, you may be dealing without a license.

Case pistol, put in trunk, drive to friends local gun shop, have shop do paperwork. Problem solved. If you do not Train, Then do not Complain When Death comes a Calling
