hello ,,sounds like ya got a real problem child there ,,i think if i bought it new and was having the problems your having ..i'd be on winchester untill they made it right,,but i don't know how there handling there repairs since the company got sold out,,
,,it sounds like you have a tight chamber,,or your shells are a little fat,,do you have any problems with 3" shells or is the problem only with 3.5 shells?i'm not a fan of the 3.5 shells.. have you tried different shells ?different makers ?is it from the get go or after it's been fired a few times ?i'm not sure how deep the chamber is on these ,,have your gunsmith check the chamber depth to make sure it will seat the shells properly,,if the chamber is short then possibly the shells have to be forced into the barrel a little to actually lock into battery,,there could be many reasons that it isn't locking up..dirt or unfired powder buildup,,
a weak spring could also be a problem but if it's working ok with regular 3" loads then it's gotta be something with the shells or the chamber is short or tight near the crimp end were the shell seats..
just a few suggestions to think about,,a good gunsmith could do a chamber cast and then measure your chamber and see if the shells your useing will work without sticking going in,,thats just my 2 cents worth and proably the first place i'd check if i were having the same problem..also if you find out that it is a chamber issue i think i'd be complaining to winchester and have them fix it or replace it,,it should work properly,,and not having a tight lockup could present a problem if you have an accidental discharge..it's an issue that needs corrected,,
