One of the problems of owning a gun for self defence is that even if it might defend you in your hour of need, nothing, especially not the gun will protect you later from being sued civilly even if you have had criminal charges against you dismissed as your action was self defence.
Out of all the gun laws, this is the one that sucks the most.
But apparently, this is not a Country wide problem, For example, did you know that Illinois Had a Civil Immunity Law for Self Defence? I didn’t and neither did Don, The Armed School Teacher. Don posted a whole article on this law, and how he learned about it. Very worth the time - go over and read.
Nancy–Here is Colorado’s law which has civil immunity. It usually gets referred to as the, “Make My Day Law” Having worked fugitive it is important to note that it takes an intruder into a dwelling. The cop shows where entrance is demanded and then the door bashed in by SWAT is so rare as to be fiction. You can’t shoot someone in your yard, apt common area, etc.
Dwelling means enclosed occupied living space. An intruder can be a cop however and this has been to appeals court so I included some annotations from appeals. The idea of civil immunity is pretty old news–surprised it hasn’t come up here before.
ASIDE–A zoning official in a mountain county boasted to me that he had made the county annoint him a “building inspector” so he could trespass on anybody’s land anytime. I asked him if he was aware of the make my day law? No. Jaw dropped when I told him he might just be shot as an intruder as he swaggered into a building or shed on an acre of land. People just don’t take trespassing or stepping into an open garage as a crime. Some felonies. Thor

now thats a law thats has some merit! along time ago when i was young and dumb..lol..a local police cheif told me something that has stuck with me to this day,,he said if someone threatens you or breaks into your home and threatens you or your family harm and you deceide to use a firearm to protect yourself or your family,,make sure you make that first shot be the only one you need ..if they try to get away…don’t let that happen,,and make sure there not wiggling when ya call us..because the next person that calls you will be there lawyer..I live in a rual community and always said “if you break in here at night”..”get your toe tag validated before youleave!” ..lol..
