I'm eating dinner in a local diner and have my concealed carry pistol with me. A robber walks in and pulls a gun, points it at the cashier and demands cash or he will shoot. I'm sitting about 20 feet away in a booth.

Not being a LEO, do I take any action or do I sit still as long as the robber does not actually begin shooting? If he actually fires his gun, can I (should I) use mine? Certainly I do not want to just shoot him in the back as he stands pointing his gun at the cashier.

You are not a LEO. Is your life or anyone else's likely in immediate danger? Are you willing to go to court and face possible financial ruin for anyone's life but yours or your family? You are the only one who can decide these.

I would not want to shoot anyone. If it looks like he'll just take the money and leave, I would let him. If you can get your gun out without the other customers seeing it, do it. You don't want to have to try a fast draw since he is already holding his gun. Be ready to shoot if you have to.
